(a) Your purchase of materials or merchandise utilizing this Storefront site signifies your express agreement to and acceptance of these terms, conditions, disclaimers and limitations of liability. If you do not agree to and accept these terms, conditions, disclaimers and limitations, you may not purchase any materials or merchandise from this Storefront site.
(b) CPF does not represent or warrant that particular materials or merchandise displayed on the Storefront site will be available at all times or precisely conform to the descriptions or depictions thereof that are provided here.
(c) Charlotte Pipe is not responsible for failure of or delay in performance under any quotation or agreement, or in delivery of product ordered, by reason of a force majeure event affecting Charlotte Pipe or any of its suppliers. A "force majeure event" shall include fire, flood, weather event, riot, strike, labor dispute, common carrier accident or failure, acts of God, acts of terrorists, public enemies, war or civil disturbance, any future laws, rules, regulations, orders or acts of any governmental entity, or any cause beyond the reasonable control of Charlotte Pipe or any of its suppliers.
(d) CPF MAKES NO WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO ALL MATERIALS AND MERCHANDISE MADE AVAILABLE FOR SALE ON THIS STOREFRONT SITE, OR WITH RESPECT TO THE USE OF THE STOREFRONT SITE. ALL MATERIALS AND MERCHANDISE ARE SOLD AND THIS STOREFRONT SITE IS MADE AVAILABLE ON AN "AS IS" AND "AS AVAILABLE" BASIS. UNDER NO CIRCUMSTANCES SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) THAT RESULT FROM YOUR USE OF THE STOREFRONT SITE OR PURCHASE OF GOODS USING THIS SITE. BECAUSE THE LAW IN SOME STATES DOES NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
